Right to an itemised pay statement

Right to an itemised payment

It’s everyone’s favourite time of month - the ailing bank account gains another reprieve as your salary is finally deposited. However, do you know what exactly is on your payslip and what to do if you want to query it?

Under the terms of the Employment Rights Act 1996, every employee has the right to be given a written, itemised pay statement from the first time they are paid.

It should contain the following:
the gross amount of the wages or salary
the amounts of any variable and fixed deductions and the reasons for them
the net amount of any salary payable

The employer may not deduct any money from an employee’s wages or salary unless:
the deduction is required or authorised by statute
the deduction is required by the contract of employment
the employee has agreed to the deduction beforehand and in writing
there has been an overpayment by the employer previously

Where an employer does not provide a statement and/or makes unauthorised deductions from an employee’s salary or wages, the employee may apply to an industrial tribunal.
